Show :CADY WANTED Dealt With Two Clubs at Once in Efforts to Land Berth. If Forrest Cady, veteran catcher, proves as good a hustler with the Phillies Phil-lies this season ss he was tvhen looking for a job during the winter, he should make Manager Jack Coombs a valuable man. The details of Cady's efforts to get quick action on employment for the season are given in the text of a national na-tional commission decision on his case, in which the Phillies and the San Francisco Fran-cisco club rTtb claimed his services. He was awarded to Philadelphia in the following fol-lowing ruling: In the latter part of February, Secretary Secre-tary Farrell notified the commission that the San Francisco club claimed Player Forrest Cady, who, subsequent to accepting its terms, signed a contract with the Philadelphia National league club. The plavers' telegram of February IS, addressed to President Baker, reads as follows: ' ' Bishop Hill, III., February 1, 1919. V F. Baker, Philadelphia Baseball Club, Philadelphia, Letter from Coombs. "Want $5u0 per month. Car fare both ways. Answer iD twenty-four twenty-four hours. " To this President Baker on February 19, within the time limit of twenty-four hours, answered as follows: "Terms accepted. Contract follnwinff." On February 19, President Baker wrote the player as follows: Confirming Confirm-ing my telegram of today. I am inclosing inclos-ing von herewith a contract for $300 per month. Your car fare will be paid both wavs, etc., etc." The evidence also establishes that on the same dav that the player telegraphed tele-graphed terms to the Philadelphia club, he also submitted by wire a telegraphic tender of his services to the Sau Francisco Fran-cisco club, with which he hud been negotiating, nego-tiating, as follows: Three fifty dollars dol-lars per month. Seven months' contract. con-tract. Car fare both ways. If sold or drafted want half. Answer at once. It is between vou and another club." i On February 19 the San Francisco club notified the player as follows: 'Your terms accepted. VWU forward contract at once. Writing letter.".. The testimony clearly shows that the plaver, while a 'free agent, was in negotiations nego-tiations for his services with the Philadelphia Phila-delphia club and the San Francisco club at the same time. It i? established beyond be-yond question that in hs proposition to the Philadelphia club he gave it tweuty-fouT tweuty-fouT hours in which to accept his terms. It is furthermore proven that within the prescribed time tho Philadelphia club aecei ted his terms. That club's . ri"ht to the piaver is substantiated and " the San Francisco club's claim is there-' ' fore dismissed. |
