The. petition of Bankers Trust company, com-pany, the administrator of the estate of John Scussei, deceased, for confirmation ol sale of the following described rwU estate es-tate of said deceased, to wit: That portion of Block 10, Plat 'A' Wilkes Official Survey of Bingham Town-site, Town-site, described as: Commencing at Roadstone No. 9, Plat "A," and running thence South 22 deg-56 deg-56 min. West 247.7 feet to a point on Wilkes Road Line, thence North 66 deg. 23 min. West. 6S.95 feet; thence Worth 63 deg. 26 min. West &5.$ feet lor a place of beginning"; thence South lfl dog 86 min. iWeet 76.6 feet; thence .North 62 deg. 26 3itn. West L7 feet; thence Nontn 23 deg. 07 min. East 74.S Xeet; thence South 63. deg. 26 min. East 76.6 feet to the place of beginning. Together with right of way leading to and from said tract over present path and stairs, about three feet in width, which right of way Is to travel by foot to and from said premises, and also for water and sewer pipes leading from the street to and from said premises, but said right of way is not for teams tar vehicles or for any purpose other than above. Reserving, Re-serving, however, for the benefit of eald estate and all persons who may hereafter here-after own the remaining property of said estate adjacent to the property so eold the right to close said right of way and substitute in lieu thereof the right of way leading to and from said premises to the street over a strip of land three feet In width on one side of the part of said lot remaining the property of said estate, for the sum of $1100.00, and upon the following terms, to wit: P'or cash, as appears from the return of sale (lied In this court, has been set for hearing on Friday, the 4th day of April, A.
