Smith, admtnis- trator of the estate of William Slater, deceased, against James and Rosetta Shupe. which was on trial in the dis-; dis-; trlct court today before Judge Alfred W. Agee and a jury. The verdict of the jury i on the first cause of action was in favor of the plaintiffs and in the second cause of action it was for the defendant. Smith, as administrator of tlie estate brought suit to bring the sum of $2581, i given to the Shupes, into the estate, to-j to-j gether with certain cows held by the defendants, de-fendants, which were alleged to be part of the estate. The jury decided that the gift of $2CSL was a gift made by Slater before he died to the defendants in the action, but on the second cause of action the jury decided against the defendants in that it held the cows should be part of the estate and assessed the damages at $128. |
