Show HI DESIRE PERilg FUND Legislative Committee Prepares Enactments to Be Submitted to the Legislature. INSURANCE COMPANIES ASKED TO CONTRIBUTE Recently Organized Utah State Firemen's Association Gets Down to Business. Members of the Salt Lake City fire department are highly pleased with tho work done by the legislative committee of tho newly organized Utah State Firemen's association in preparing a letter and enactments to bo presented at the next session of the state legislature legisla-ture requesting tho passage of a bill for a state firemen's relief fund. The Utah Stato Firemen ?s association was formed in this city a few weeks ago. Other than tho organization of tho association, the most importanr business was the selection of n legislative committee. com-mittee. The legislative committeo began its task soon after the adjournment of the meeting in this city and now has the letter and enactments prepared. The letter to bo presented requesting I ho legislators to enact a law providing provid-ing for a fund contains information as to the purpose of tho fuud. It siiows the amount of insurance business written in the fire lino for the year of 1907, premiums received, losses incurred and tho profits. The committee is composed of G. W. Morse, A. D. Boll, A. L. Heastou, E. E. Burton. William Caldwell, George Z. Edwards, ,T. E. Armistead, John Funk, W. W. Wilson. Charles L. Shoely, J. W. Jh-de, J. E. Driscoll and William Hanson. Han-son. The enactments to be presented aro as follows: Outline of Bill. An act to create a Firemen's Relief Fund, and to Increase tho efficiency of the flro departments In tho several towns and cities in tho state of Utah. Bo it enacted by the legislature of the stato of Utah: Section 1. That every flro Insurance company, corporation or association doing business in any incorporated town or city in Utah that has, or may hereafter have, a regular organized flro dopartmcnt under tho control of the mayor and city council or other governing body of said town or city, and which has In serviceable condition condi-tion for fire duly apparatus and equipment equip-ment amounting in value to fivo hundred dollars or more, shall return to the secretary secre-tary of state a just and true account of all "premiums collected and received from all flro Insurance business done within the corporate limits of the said towns and cities during the year ending December 31, or such portion thereof us they may havo transacted such business In such towns or cities. Such returns to bo mado by the. said companies, corporations or associations within nlxty days from and after the 31st day of December of each year. 2. Every fire insurance company aforesaid afore-said shall, within sixty days after tho 31st day of December of each year, deliver de-liver and pay to the secretary of state tho sum of one dollar and fifty cents upon the one hundred dollars, and at that rnto upon the amount of all premiums written on flro and lightning within tho limits of such Incorporated town or city during the year ending December 31 in each year, or for such portion of such period as said company shall have done business in said city or town. .". Every such company shall keep accurate ac-curate books of account of all business done by them on flro and lightning insurance in-surance within the limits of such incorporated incor-porated town or city, and in case any fraud or dishonesty in said returns mado by such company, as provided for in section sec-tion 1 of this act, be apparent, it shall be the duty of tho secretary of stato to investigate said returns and collect the amount which he shall find to bo due. I. Every flro insurance company which shall neglect to keep such oooks of account ac-count as aforosald, or shall fall or neglect neg-lect to report or pay over any of the money due on premiums received as aforesaid at the times and in the manner man-ner specified in the preceding section of this act, or shall be found upon examination exami-nation to have made a false return of. business done by them, shall for each offense of-fense forfeit, for the use and benefit of such fire department of such town or city, the sum of one hundred dollars for each day such statement or payment is delayed. Said forfeiture may be collected by an action to be instituted by tho attorney-general in the name of the state. May Revoke Authority. The secretary of stale may revoke the certificate of authority of any company falling or refusing to pay such money within the timea limited, and it shall bo unlawful for such company or any agent or solicitor thereof to solicit or receive application for Insurance until tho secretary secre-tary of stale, has issued to tho company a new certificate of authority. Ti. The secretary of state shall pay over all tho moneys pertaining to this act, collected from the Insurance companies, associations or corporations, doing business busi-ness within the towns or cities having, or that mny hereafter have, a regular organized flre department, ns aforesaid. In section 1 of this act, excepting three per centum thereof, to tho treasurer of tho Fircmen'H Relief association of such town or city, said association to be composed com-posed of the members of tho flro department depart-ment of such town or city, and to be incorporated in-corporated under tho laws of this state; and the three per centum thereof, ns aforesaid, shall bo paid over to tho treasurer treas-urer of the Utah State Firemen's association, asso-ciation, and shall bo used by tho Utah Stuto Firemen's association as may bo regulated by said association in offering and paying prizes to be offered to efficient, effi-cient, wall-drilled and skilled fire departments depart-ments belonging to tho said association in the state of Utah, competing at tho an-nuul an-nuul tournamituts of the Utah Slate Firemen's Fire-men's association, to he held annually at places to be selected by said association within the slulo of Utah, with a view to encouraclng and maintaining efficient, woll-drllled and skilled fire departments belonging to said association within the stuto of Utah. AH moneys collected and received un-' un-' dcr the provisions of this act, excepting " throe per centum thereof as aforesaid, I shall bo held In trust and used solely and ! entirely for the relief of any member of j tho fire department of such town or cltv. when Injured or physically disabled in or by reason of the discharge of his duties du-ties as .such, and for the relief of or the payment of gratuities to the widow or thoso dependent upon any member of such firo department who may bo killed in the discharge of his duties as fireman or who may dlo from tho effects of injuries in-juries so received or from disease contracted con-tracted by reason of his duties as such, and for tho payment of the necessary funeral expenses of any member of such fire department when killed In the discharge dis-charge of his duties as fireman, or in case of death resulting from the effects of Injuries so received or disease contracted con-tracted by reason of his duties as such. 7. This net shall tako effect and be In force from and after Its passage, approval and publication In the official state paper. |
