Show BOTH GLAYS Bill H GEIIING SEPAH Wife Wants Separate Maintenance Mainte-nance Decree, and Hns-hand Hns-hand a Divorce. Tho separate maintenance-divorce suit of Delia Clays against jM. V. Clays, in which tho wife asks for tho first-named first-named relief and the husband the second, sec-ond, was taken up beforo Judge Morse in the equity division of the third district dis-trict court Tuesday afternoon. Mr. and M.rs. Clays were married on November No-vember 22, 1S92. and during a greater portion of tho timo since 1900 Mrs. Clays Jias had her husband's property tied up with restraining orders and injunctions. in-junctions. Mr. Clays alleges that his wife has a mania for filing suits against him, and tho statement is borne out. by the record. Mrs. Clays filed her first suit in Tooele county in 1DD0, but later dismissed dis-missed the action. The next action was filed in this county in November, i 1902, and was pending until March 19, 1907, when it was dismissed. Two days la tor. however, Mrs. Clays filed tho suit which is now being tried. This is an action for separate maintenance. Mr. ('Jays, however, is asking for absolute divorce. Mrs. f.'lavs asks for relief on the ground that her husband has deserted her, and he asks for relief upon tho ground (hat Mrs. Clays has not treated him with tho consideration with which a wife should treat her husband. Mr. Clays is a well known saloon and milling man. and has interests in both Utah arid Nevada. Mrs. Clays operates a rooming house in this city, and is said to have considerable properly in her nwn .name J. M.
