Show MAY GALL A GRAND JURY Method Proposed to Investigate Investi-gate Police Doings JUDGE NORRELL MAY ACT City Attorney Stephens Suggests to the Judge that in the Absence of Any Action by the County Attorney Attor-ney it Would be Propel to Summon Sum-mon a Grand Jury t Investigate the Action of the Police in Causing Caus-ing the Three Girls to Undergo an Examination I ely Attprnoy Stephens Is of the opinion that public necessity demands that I grand jury be called to Investigate Inves-tigate the conduct the police department depart-ment In causing three young girls to undergo the physical examination which has caused so much comment the past week Mr Stephens says that as the Chief of Police takes the position that the course pursued was Justified and as the County Attorney seeing disinclined to take any steps In the matter something ought to be done to determine whether the law confers the power upon the police which has been exercised in this Instance In-stance CITY ATTORNEYS SUGGESTION With that and the punishment of those responsible for arrogating powers pow-ers which Mr Stephens thinks they dont possess in Iew he called upon Judge Norrell in chambers ycstcrdav and suggested l that the present instance in-stance was one in which It was proper for the Judge to exercise the power given him lo call a grand Jury to make an investigation and to return Indictments if it llnds that the law has been violated JIr Stephens called Judge Norrclla attention to sections iMl and 118S of the Revised Statutes as applicable to the case The first section quoted forbids for-bids inhumanity to 01 oppression of prisoners and provides a penalty of a fine not exceeding 1000 or not exceeding ex-ceeding one years Imprisonment In the county Jail or both In the discretion discre-tion of the court The latter section Is directed against false Imprisonment the penally being a fine not exceeding 53000 not Imprisonment or exceeding one year 11 prisonment in the county jail or both AGAINST SWEATBOX Those sections Mr Stephens thinks are directly applicable to this case and he also thinks that the system of putting put-ting prisoners In the sweatbox to extort confessions from them which is sometimes practiced should be looked into by the grand Jury and stopped The Investigation should Mr Stephens Steph-ens says extend to all parties who had any responsibility for the affair but in this connection he said that he had no idea that Dr King know that any pressure had been brought on the girls to make them submit lo the examination ex-amination or knew anything of the cause or circumstances of the arrests I Is entirely In the discretion of the Judge whether he will call a grand Jury not If he thinks or not public necessity neces-sity demands It the law authorizes him to do so HAS IT UNDER ADVISEMENT Judge Norrell said last evening that he was considering tho propriety of acting on Mr Stephenss suggestion and that he would arrive at an early decision probably on Monday or Tuesday A grand Jury in thc Stale consists of seven members five of whom con stitule a quorum and five are necessary neces-sary to Indict They have Jurisdiction over all classes of felonies aud mIsdemeanors |
