Ogden Sept 19 There was a very lively rumpus on Washington avenue near the Utah National bank yesterday afternoon about 4 oclock I resulted from the hearing of a trial before Justice Jus-tice Gideon Peter Johnson was charged charg-ed by Special Detective F 1 Wheeler of the U P with stealing some lumber lum-ber Johnson vas tried before a jury and acquitted During the course of the trial Attorney John Murphy so it Is ald declared that S 4d any man who fouid tr to magnify such a petty of ence as the one with which the de fOndant rnie was charged was A scoundrel This seems to have enraged Wheeler who accosted Murphy on the bank corner cor-ner and demanded to know what he meant Murphy replied that he meant exactly what he said Wheeler struck at Murphy and In the racket which followed the attorney was inclined to crowd matters when Wheeler drew a gun and the bystanders say snapped it at Murphy They were separated bet be-t or1 any serious damage was done Whoeler was subsequently arrested and taken before Commissioner Ternes who fined him 5 for battery
