President H Samuel Gompers, Vice President John H Mitchell and Secretary Frank Morrl- H son of the American Federation of H Labor appeared In tho equity branch H of tho supreme court of the District M of Columbia today to resist the latest H contempt order issued against them H by Justice WrlghL , H The first moves were of a technical H nature and were overruled by Justice H WrlghL v". AMlSsiim) M A motion to dismiss on the ground H that the service of tho order was In- H complete was sustained, but when H Justice Wright directed the marshal H to serve new papers forthwith the JH point was waived. The defendants tH moved to dismiss becauso the report jH of the committee of lawyers submit- H ted to tho court In the case was not H a proper one, In that tho members of jH the committee were counsel for the f H National Anti-Boycott association and H that the conclusion of the Bucks H Stove and Range company's case did H not stop "their persecution of theso I H defendants and therefore they were H not qualified to pass judgment on tho H acts of the defendants.'' H The hearing today promised to bo H a lengthy one. If all of the various tM motions "by the defendants are dls- ( H missed, an answer to the order will H ho filed within the next two weeks. H Should the court hold that the answer H raises a question of facts, the cae ( H will go over until October, when all H the members of tho district court H probably will sit with Justice Wright H as advisers. This was announced by, H Justice Wright today. M Technically tho defendants appear- H ed bv counsel only today, Judge Al- H ton B. Parker of New York and tho H local law firm of Ralston- Siddon & H Richards representing. But In real- H ity all three were on hand before M court convened, conferring with their H lawyers and friends. , H J. J.
