Show Public Defender Appointed by Council Local attorney J. Bruce Savage has been appointed to the newly created post of Park City Public Defender. In that position, Savage will provide legal service to indigent defendants who could not otherwise afford an attorney. Federal law and state statute dictates cities must provide legal services to indigent violators of municipal ordinances upon request. The right to a court appointed attorney is guaranteed gua-ranteed under the 14th amendment of the United States Constitution. According to City Manager Arlene Loble the position was never filled in Park City because there were never any requests, until now, for court appointed legal counsel. coun-sel. Currently, there are at least three such cases pending before Park City Justice Kibly. As Park City's Public Defender, Savage will receive re-ceive $50 for a case that is plea bargained and does lnot go to trail and $300 for each case that is tried. Justice Kilby will be responsible re-sponsible for making the determination of indigency, which would entitle a defendant defen-dant to the free legal services. City Attorney Tom Clyde called the sudden need for a public defender a "sign of the times" and an indicator of Park City's recent growth. |
