Show SCHNEIDER TO TEST LAW Otto Schneider, the South Washington Washing-ton street grocery man. who a short time ago was tried for violating tho Sunday closing ordinances, found guilty and fined $5, has appealed from the decision of the municipal court and the papers in the case hae lcen certified to the district court. It Is said by Schneider that he Is going to test the constitutionality of the Sunday Sun-day closing ordinance. The contention of his attorney Is that the ordinance in question Is discriminating dis-criminating In that It prohibits the sale of groceries on the Sabbath day and permits the sale of other things, such as drugs, candles, cigars. Ice cream, etc. Tho further contention Is made that the ordinance has exceeded the authority given by tho state law. The criminal case of H. Mitchell, charred with grand larceny, has been certified to tho district court and he Is being held In the county jail pending pend-ing the action of the district attorney In the fli ng of an Information against him. The defendant was bound over to the district court a few days ago by Judge Murphy of the municipal court. L. Lang, charged with a felony, asked three more days' time In which to plead to tbo information. Judge Howell granted th0 extension. John Woods, a necro. charged with the crime of assault with a deadly weapon, pleaded not guilty. Tho time for the hearing of the case will bo fixed at fome future lime. |
