Show HARRY ROSS IS FOUND NOT GUILTY After a trial which occupied the attention at-tention of the district court for a greater part of the day, a jury found Harry Ross not guilty of the charge of forgery It was alleged In this, the second action brought against Ross, that on October 3, 1910, he forged the name of H Bateman & Co. to a check on the First National bank of this city for $16.75. Although found not guilty, Ross was not released from the county jail last evening. He Is being held on Instructions Instruc-tions from the sheriff of Davis county, who holds a warrant charging Ross with forger. The Davis county officer offi-cer is expected to come and get Ross today. The Jury sworn to hear the case was composed of the following persons: James M Daley. D M Moore.'Geo W Snivel, Jr., J H. Knauss, William Wil-liam L Russell. Richard D Brown, Alma T. Doxey and John Nichols. At the previous trial, a few months ago, the jury rendered a verdict of not guilty, the state falling to prove that Ross uttored, or published, the check in question. Ross was then charged with forging a check on the same company, but for a lesser amount. Henry Bateman and Daniel Doyle, of tile firm of H Bateman and Company, testified today that the signature on the oheck was not written by them and that they had not given Ross authority to write the firm name on checks "or in any other way. Leroy Chad wick, who was employed by the Marshall Mercantile compnny of North Ogden, October S. 1910, testified tes-tified that tho defendant camo to the st6re and tendered the check in payment pay-ment for a pair of gloves. He accepted accept-ed tho check and gave to Ross in cash tho difference between tho prlco of tho gloves and the marked value of the check. He was positive as to .the Identification of Ross. |
