Show ORDER, SUMMONS AND NOTICE Civil No. 2147 IN THE DISTRICT COURT OF THE FIFTH JUDICIAL DISTRICT IN AND FOR IRON COUNTY, STATE OF UTAH IN THE MATTER OF THE GENERAL GEN-ERAL DETERMINATION OF THE RIGHTS TO THE USE OF WATER, WA-TER, BOTH SURFACE AND UN-DERGROUND UN-DERGROUND IN THE CEDAR VALLEY DRAINAGE AREA INCLUDING IN-CLUDING ALL SURFACE WATER TRIBUTARY TO THE CEDAR CITY UNDERGROUND WATER BASIN, INCLUDING BUT NOT LIMITED TO COAL CREEK, SUMMIT CREEK, BRAFFTTS CREEK, QUITCHUPAH CREEK, CREEK, SCHURTZ CREEK DUN-CAN DUN-CAN CREEK. HUNTER CREEK. GREEN'S LAKE CREEK, FIDDLERS FID-DLERS CREEK, SQUAW CAVE CREEK, GROVES CREEK, WATSON'S WAT-SON'S GULCH, ROCK CANYON CREEK AND ALL OTHER SURFACE SUR-FACE TRIBUTARIES OF SAID BASIN The State Engineer of the State of Utah having filed herein a Proposed Determination of all Water Rights, both surface and underground, in the above mentioned men-tioned drainage area, pursuant to the provisions of Chapter 4, Title 73, Utah Code Annotated 1953, and it appearing by affidavit affida-vit that the State Engineer has made due and diligent search and inquiry to ascertain the names of all claimants to the use of water, both surface or underground, within said drainage drain-age area, and has caused summons sum-mons to be personally served upon or has secured the entry of an appearance by all claimants claim-ants whose names and places of residence or post office addresses have been ascertained, and has also caused to be mailed to each of said claimants whose names and places of residence or post office of-fice addresses have been so ascertained as-certained a copy of said Proposed Pro-posed Determination of Water Rights; and it further appearing that the State Engineer has done or performed all acts and things required of him under and by virtue of said Chapter 4 of title 73, Utah Code Annotated 1953; now, therefore, it is hereby ORDERED that Wednesday, the 24th day of Februarv. 1954. at 10:00 a. m. at the courtroom of the above entitled Court in Paro-wan, Paro-wan, Iron County, Utah, be, and it is hereby, fixed as the time and place for the commencement of hearings in the above entitled matter and that all claimants and all persons having objections objec-tions to the approval by the Court of said Proposed Determination Determin-ation of Water Rights, are hereby ordered and required to take notice no-tice of the aforesaid commencement commence-ment of hearings of said matter and of all continuances and adjourned ad-journed hearings thereon; and it is further ORDERED that all persons and claimants having objections to the approval of said Proposed Determination, or any part thereof, who have not heretofore filed their objections thereto, are hereby summoned and required to appear and file with the Clerk of this Court within twenty days alter the last publication of this Order their objections, or be forever for-ever barred and enjoined from asserting or claiming any right -V - - - "HI!., " .111,1, 1 1 1 1. above described and entitled drainage area and water source; except as set forth in said Proposed Pro-posed Determination and it is further ORDERED that notice of said hearings and of this Order be given gi-ven by publication of a copy of this Order once each week for five successive weeks in the Iron County Record, a weekly newspaper news-paper published at Cedar City, Iron County, Utah, said newspaper news-paper being hereby designated as the newspaper most likely to give notice to persons interested in water rights In the aforesaid drainage area.
