Show Dabb sentenced to prison in sexual child abuse case FARMINGTON A tearful 23-year-old man was handed a suspended prison sentence and ordered to pay $800 after pleading no contest to attempted sexual child abuse. Mark E. Dabb, 2249 N. 650 W., Harrisville, was sentenced Tuesday by 2nd District Court Judge Douglas Comaby on third degree felony charges. In an impassioned plea for leniency, le-niency, Dabb told the judge with tears in his eyes, that he was "sorry for the problems I have caused." Dabb's attorney, Scott Holt, explained ex-plained his client had received mental men-tal health treatment. "He has admitted ad-mitted hi s acts and he ' s cooperating. coop-erating. I would recommend no jail He needs treatment." "I spent one night in jail," said Dabb, and added, his voice cracking with emotion, "And that's a place I'd just as soon not have to go back to." Dabb was initially charged with aggravated sexual abuse of a child for an incident which occurred in Layton involving an 1 1 -year-old girl. He later entered a plea of "no contest" to the reduced charge of attempted sexual abuse of a child, a third-degree felony. The charge carries a possible maximum penalty of up to five years in the Utah State Prison, and a fine of up to $5,000 plus a 25 percent surcharge. In reviewing the case, Comaby told Holt there was some question as to whether or not "The victim was being isolated by Mr. Dabb and his wife saying she was lying about what occurred." The judge told Dabb that the victim's vic-tim's father had requested restitution restitu-tion in the amount of $7,145. "This young woman had to spend considerable time in the hospital," Comaby said, but he added that a review of her medical care indicated that none of her treatment was necessary as a result of the incident involving Dabb. "This treatment came as a result of her home life," Comaby said. After further review, the judge sentenced Dabb to prison for 0-5 years and imposed a fine of $1,500 with a $200 surcharge. Comaby stayed the prison sentence and placed plac-ed Dabb on three years probation ordering him to get "complete medical counseling." All but $800 of the fine was suspended. Dabb understands he now becomes a registered sex offender and must report to local police whenever he moves to another community. |
