Show Notice of intention to add property to summit SPECIAL SERVICE DISTRICT water services thereto, at 10 a.m. on Monday, May 24, 1982. Any person interested in-terested may protest the establishment and the addition of properties described above to the Summit Special Service District or the furnishing of said services therein either orally at the hearing or in writing, or at any time prior to the hearing. Written protests must be filed with the County Clerk, and may be withdrawn by the protestant at any time before the County Comission establishes or abandons the property additions to the Special Service District. Any protest signed on behalf of a corporation owning property in the proposed additions to the Special Service District shall be sufficient if it is signed by the president, vice president, or any duly authorized agent of the corporation. Where title to any property is held in the name of more than one person, all of the persons holding title to the property must join in the signing of the protest. At said public hearing, the County Commission wil give full consideration to all protests which shall have been filed and will hear and consider all interested persons desiring to be heard. The Commission may continue con-tinue the hearing from time to time. After conclusion of the hearing, the Comission shall adopt a resolution either establishing the additions to the Summit Special Service District or determining that the establishment of said additions should be abandoned, or may, in its discretion, reduce the boundary of said additions ad-ditions and establish said additions, as modified. If, within f if ten (15) days after the conclusion of the hearing, over fifty percent (50) of the qualified voters of the territory proposed to be : added to the Special" Service District , file written protests against the addition to the Special Service District with the County Clerk, the County Commission is required by law to abandon the proposed establishment of said District. Any person who shall, or at any time prior to the date and time above specified for the hearing, file a written protest with the County Clerk against the establishment of the additions to the Special Service District, and whose property has been included within the additions ad-ditions to the Special Service District, and whose property has been included within the additions ad-ditions to the Special Service District notwithstanding not-withstanding such protests, may, within thirty (30) days after the adoption of the Resolution establishing the a additions to the District, apply to the District Court of the Fifth Judicial District for a writ of review of the actions of the County Commission in establishing said additions ad-ditions to the Special Service District, only upon the grounds, however, that his property will not be benefited by the services authorized to be furnished fur-nished by the additions to the Service District or that the proceedings taken in the establishment establish-ment of the District have not been in compliance with law. A failure to apply for such writ of review within the prescribed time shall foreclose all owners of property within the proposed additions to the Special Service District so established from the right further to object thereto. Notice is hereby given that on April 26, 1982, the County Commission of Iron County, Utah, adopted a Resolution declaring that the public health, convenience and necessity require the addition of properties to the Special Service District in Iron County, known as the "Summit Special Service District," for the purpose of providing water services within the boundaries of said Service District. Said Resolution also provides for a public hearing on the establishment establish-ment of said Speical Service District in the County Commission Chambers in Parowan, Utah, at 10 a.m. on May 24, 1982. Description of Proposed District Addition Said additions to the Special Service District shall include the following property: The Summit Cemetary, described as follows: Commencing at a point 67 rods North and 2.33 rods East of the Southwest South-west Corner of the Southwest South-west quarter of the Northwest quarter of Section 36, Township 34 South, Range 10 West, Salt Lake Base and Meridian. Thence North 19.4 rods, thence Northeasterly Nor-theasterly along Interstate In-terstate 15 13.4 rod-s.thence rod-s.thence South 28.2 rods, thence West 10.8 rods to the point of beginning. The Blackburn and Dalley property, described as: Commencing at a point 43 rods East and 137 rods South of the Northwest corner of Section 36, Township 34 South, Range 10 West, Salt Lake Base and Meridian. Thence East 21 rods, thence South 11.2 rods, thence West 21 rods, thence North 11.2 rods to the point of beginning. Excluding a small acreage for the existing County road. Additional property, described as: Commencing at the Northeast corner of the Southeast quarter of Section 35, Township 34 South, Range 10 West, Salt Lake Base and Meridian. Thence West 65 rods, thence South 18 rods, thence East 65 rods,-thence rods,-thence North 18 rods to the point of beginning. Proposed Services The Summit Special Service District will be authorized to provide water services to the above-described property. Water services will be initially provided through the construction of a water storage tank, water treatment facilities, and construction con-struction and installation of water distribution lines, all to be located within the District, together with necesary appurtenances and equipment therefore. Method of Financing Pursuant to the provisions of the Utah Special Service District Act, Utah Code Annotated, An-notated, Sections 11-23-1 to -29, as amended, and Article XIV, Section 8 of the Utah Constitution, the Summit Special Service District may annually impose fees and charges to pay for all or a part of the services to be provided by said District. It may also annually levy taxes upon all taxable property within said District, to provide the proposed services, amd may issue bonds for the acquisition and construction con-struction of facilities or systems t to provide said services, provided, however, that said tax levy to provide said services or to repay said bonds, must be authorized and approved by a majority of the qualified electors of said Special Service District at an election for that purpose. Public Hearing on Proposed Additions to the "Special Service District The County Commission Com-mission will hold a public hearing on the addition of the above described property to the Summit Special Service District and the furnishing of |
