Show Skirmish With Cupid Puts U.S. Enlisted Man in Jail A former enlisted man of the United States army Tuesday was In the Salt Lake county Jail, an outgrowth of circumstances arising aris-ing out of his marriage allegedly in violation of army regulations, and District Judge Herbert M. Schiller In strong terms had condemned con-demned the practice of marriage and divorse "in an apparent effort to evade military service." Simultaneously, Major Nicholas Szilagyi, Fort Douglas adjutant, told The Telegram there had been a "marked decline" of soldier marriages mar-riages since late August, when that type of nuptials appeared to be at a high point, as a result of an army regulation which became effective ef-fective July 1. Macrae Lawrence Barnson, 21, who was discharged from the army September 14 after he contracted con-tracted an alleged unauthorized marriage with Ruth Elaine Hib-bert, Hib-bert, 21. of 132 Dooley court. They were married August 25. The army regulation which forbade the marriage, mar-riage, without consent of the enlisted en-listed man's commanding officer, provided honorable discharge of the soldier as punishment. Mrs. Barnson filed suit for divorce di-vorce in Third district court last week. She alleged nonsupport, and her attorney subsequently obtained ob-tained a show cause order citing Barnson to explain why he failed 19 pay 810 per month temporary alimony. It was that order which took Barnson before Judge Schiller..- After refusing to grant the divorce di-vorce and continuing the rase until un-til October IS, Judge Schiller expressed ex-pressed .his belief that the proceeding pro-ceeding hefore him, as well as Incident! which led up to the divorce di-vorce complaint, resulted from "collusion." "This court cannot be used by soldiers seeking discharge from the army through the quirk marriage-quick divorce method," said Judge Schiller from the bench. The Judge found Barnson guilty of contempt of court by reason of the Utters failure to comply with the court order requiring payment of $10 per month temporary tempo-rary alimony. A sentence of 10 days In Jail was imposed and subsequently sub-sequently the Judge set bond at $300 in case Barnson . desired to appeal the judgment.
