Show j. At i ITave Ko Nzt on Railroad's Rail-road's Premises Except . by Permission. An Important test case affecting every hack driver in the city was decided by Judge Diehl . In the City court this morning. ' The case was that of the city against R. S. Webb and Ed Wilkinson charged with trespass. The Oregon Short Line Railway company com-pany has given permission to a certain transfer company to allow Its hacks to stand In the railroad depot yard more than ten minutes before the arrival of trains. Other nackmen are denied this privilege. Webb and Wilkinson decided to make a test of the legality of the railway company's action In ordering them oft the grounds, and upon their refusal to leave when ordered to do so, were arrested, ar-rested, and tried several days ago. The decision of the case was reserved -by Judge Diehl until this morning. In giving his Judgment which was a conviction of the defendants, Webb and Wilkinson, Judge Diehl said that a case exactly parallel to the one In point had been decided In the United States Circuit Cir-cuit Court of Appeals, in which the court ruled that the duties of a common carrier, such as a railroad, did not extend ex-tend to the point of furnishing conveyances convey-ances from the station, hence the company com-pany could dispose of its grounds at the station as it chose. k . Webb and Wilkinson were accordingly according-ly found guilty, but as It was a test case no fine was Imposed. Judge Diehl announced, however, that ' all others who were convicted of a similar offense ; would be heavily fined. |
