Show WARNING TO A WITNESS Guide in Advance of Soldiers Sol-diers Fires Pistol for Purpose. JACKSON, Ky.. June 13. When the Marcum case was resumed today Commonwealth's Com-monwealth's Attorney Byrd stated that the detail sent out last night to arrest Henry Freeman. U badly-wanted witness, wit-ness, had returned without their man. Lieut. Cannard and Deputy Whltta-ker, Whltta-ker, sent by the Commonwealth, stated that Goodloe Combs, who went along on the orders of Judge Redwine, to the surprise sur-prise of the soldiers, when within 100 yards of Freeman's house, ran ahead and fired two shots. He claimed that he saw something in the road. When the soldiers arrived at Freeman's house he was not there. Evidences that he had run away when he heard the shots were shown by some garments left behind and his footprints In the earth were fresh. His wife admitted that he had been there, and she was held, but Judge Red-wine Red-wine refused ot have her as a witness. The anti-Hargls people say that Freeman Free-man is an important witness, and. they feel that he has been hired to remain away from court. Mr. Byrd said he would have to close the case without Freeman and submitted the case of the Commonwealth. Attorney O'Neal for the defense moved for peremptory instructions dismissing the defendants. Judge Redwin excused the jury to hear the arguments on the motion. |
