Show JURY DISAGREES IIH ZEKIR MURDER CASE The jury disagreed and was discharged dis-charged last night in the case of Kra-mal Kra-mal Zckir, tried in Judge C. W. Horse's division of tho Third district court on a charge of iirat degree murder for tho alleged killing of Bessin Ferran iu Bingham canyon June 1, 19 1(3. Seven of the jurors were for conviction and five were for acquittal. The case wont to the jury at 2:30 o 'clock yesterday afternoon. The court waited ULtil 5:'M) for a return, then instructed tho bailiff to hold the jury together until 1 U o 'clock and to release them as discharged at that time in ,the event of failure to agree upon a Verdict. ; The morning was takm up with argu-i argu-i ment of the case, W. K. Rydalch, counsel for the defense, contended that tho state had Jailed to moke a case,1 in that it had not established the idea- . tity of the man who sta bbed Ferrau to death as being the defendant, i The state introduced evidence during dur-ing the trial to show that a man chased j Ferran down the mountain side on the j day of the stabbing and. overtaking I him. struck lnm three times. This man, thy state contended, was the defendant. Ferran died of three knife wounds. The defense disputed this and introduced evidence to show that Ferran ha3 quarreled quar-reled the day before the stabbing with a man by the name of Canna Ismael, who disappeared the following day. The defense contended that it was he who overtook Ferran on the mountain side and was seen to strike him three times. No one saw, according to the evidence, whether the man who struck the three blows had a knife at the time. Ferran fell bleeding in the rear room of a house in the bottom of the canyon shortly after the pursuit and attack at-tack on the mountain side. |
