Show HATHAWAY CASE UNDER ADVISEMENT Before Judge E. A. Rogers of the city court tho hearing of the case of tho stato against Patrolman D. 0. Hathaway, charged with abusing William Wil-liam Enckson, a prisonor, -was concluded con-cluded yesterday morning and taken under advisement. Tho defense introduced no testimony of its own, rolj'ing upon tho testimony of witnesses for tho state to clear the acensed officer. "William H. Folland, attorney at-torney for Hathaway, moved for a dismissal on tho ground that if nny offense was committed the complaint was brought undor the wrong section of the statute; that Hathaway was not guilty of the charge specified; and that the proof varied from the offense charged. N. GL Morgan, assistant county attorney, at-torney, asked for an extension in which to file briefs. Accordingly briofs will be submitted by both sides next Saturday. |
