The effort of Rice to obtain a modification modifi-cation of tho decree so that lie could oh-tain oh-tain the custody of the children and discontinue dis-continue tho payment of alimony was denied by the court, also tho demand of Mrs. nice that her divorced husband pay her $-T, instead of $10 monthly alimony. Tho court refused to make any modification modifica-tion of the decrco and instructed Rice to continue Lhc payment of the alimony ordered or-dered at the time the divorce was granted. grant-ed. Judge Howell said he regretted circumstances cir-cumstances arc such as to deny him the opportunity of placing the children in tho custody of some one where thoy could bo properly cared for, but as tliQ evidence did not show that Mrs. .Mice had boon guilty of any misconduct since hor second marriage, the court consented to allow her the children for eight months on probation. |
