Show ATTORNEY FEES IN Y. M: C. A. CASE FIXED In the case of the Utah Savings and Trust company against the T. M. C. A. of Salt Lake City. District Judge Morse Saturday heard evidence as to tho amount o attornevs' fees to bo allowed the attorneys at-torneys for plaintiff and entered an order or-der allowing- them $1000. The action was brought to foreclose a trust deed on the propcrtv of the Y. M. C. A. for $50,000. The Y. M. C. A. regarded the original demand for $1250 for attorneys' fees In this caEC excessive, particularly ns Judge Dey. the attornoy for Colonel Wall, who brought the main foreclosure action, has collected nothing and has tlxed his fee at $300. while Stophens & Smith, the attorneys at-torneys for C. P OverfleWl, In a similar action brought at the same time, declined de-clined to accept any fco. As It was the public's money, the Y. M. C. A. preferred pre-ferred to have the amount fixed by a court, nnd this was done Saturday. All throo .of these suits were brought n year ago, and nothing was done In any of them boyond filing the original action. Judge TJey testilled. on the stand yesterday" yester-day" that, at Colonel Walls's request, ho had offered to take care of the bnnk's Interests without chargo at the time he brought his suit, but that his. offer was declined. |
