E By JU)V JLSLN " BOUNTIFUL A restraining order barring distribution of BARD funds was delivered Tuesday, from Bountiful City to all other former BARD entities. The order also ordered the other entities to appear in court on Sept. 15, to "show cause" as to why the order should not be in effect until the matter is resolved. At Tuesday's BARD meeting Bountiful Mayor Dean Stahle explained ex-plained his city had no choice but to freeze the funds. "The restraining restrain-ing order comes out of the last meeting when you gave Bountiful two options saying, 'if Bountiful does not accept one of these we'll take our money and go home.' We just acted in accordance with what " was said." "You reacted, you didn't act," responded West Bountiful Mayor Jerry Thompson. Alan Low, secretary-treasurer of the BARD, pointed out that FICA taxes are due Sept. 10 and if they are not paid, a 25 percent penalty pen-alty plus interest will be assessed. "Just don't pay them!" retorted -i? r - i f, 1 "The only way they'll get in- ? volved is by charging penalties," said Mr. Low. "Fine, I don't care; it will all j come out of Bountiful's share any- I way," said Mayor Arbuckle. "I'm in favor of paying the bills too, but let's get Bountiful to go back to the judge. They got him involved, let's ' keep him involved," he said. Bountiful City Attorney Layne Forbes suggested that a stipulation be made allowing, "operating expenses ex-penses to be paid forthwith and they will not be a part of the res- J training order." Bountiful's main ' concern is the $1.5 million closure fund that the cities had suggested be divided until the BARD is finally : closed. A discussion followed as to the legality of the stipulation and a motion mo-tion to allow the change narrowly passed with board chairman Mayor Thompson breaking a tie vote. Mayor Stahle then explained that his council could not accept either of the two proposals offered at the last BARD meeting. The first would have divided the contingency fund now with each city participating in closure costs in the future, and the second would have given Bountiful all of the BARD assets, including the contingency con-tingency fund, at this time, with -future liability to the other entities ' extending only up to June 30, 1987, the last day they used the BARD. The new proposal made by Bountiful is identical to the second proposal made in July by the BARD with the exception that it Continued on page two BARD board Continued from Page 1 does not deal with liability. Mayor Stahle said the question of liability cannot be answered until the BARD is finally closed. "There are a lot of unknowns that we need to discuss," he said. After a brief executive session, the BARD members agreed to allow Bountiful to present their new proposal, in writing to the BARD members for their consideration. consider-ation.
