David Ostler, who three days ago pleaded guilty to , the charge of obtaining money under ( false pretenses, was given an opportunity oppor-tunity yesterday morning to right the ! wrong committed by him in thlB regard, re-gard, when the case againBt him was continued without date and the prisoner pris-oner vrtio has been in the county jail for about a week, -was released on his own recognizance. Having previously entered hm plea of guilty, Ostler appeared yesterday morning before Judge B. A. Rogers In the criminal division of the city court for further disposition of his case. H. Van Dam, Jr., assistant county attorney, who appeared tor the stale, made the statement to the court that the offense charged was the passing of a flptitious check for 32, and that he understood Ostler, while intoxicated, intoxicat-ed, had passed three or four other checks of tho same amount. He did not desire to be severe, but thought that sentence of sixty days in jail would be Just punishment. Judge Rogers said that he believed the ends of justice would be better served by allowing the defendant an I opportunity to make good the checks J that he had given out. Attorney Van Dam then questioned Ostler, learned j that he was a married man with a family, exactod a pledge In opon court that he would promptly do all in his power to make good the few checks that he had passed and consented to the recommendation of Judge Rogers, who then continued the case without date and ordered the release of the de-fondant. |
