Three courts todaj' rendered decisions affecting af-fecting the right of the city of Helena to sell $000,000 of water bonds tomorrow tomor-row at noon, and unless further proceedings pro-ceedings are Instituted, tho city will proceed with the sale. The moBt Important decision was that rendered by United States Judge Gilbert, at Portland, late this afternoon, after-noon, In tho application of Receiver C. E. Bonekus, of the Helena Waterworks Water-works company, for an injunction to prevent tho city from selling the bonds and installing a municipal water plant. This case was heard in Portland Port-land by reason of the fact that Federal Judcc. Carl Ra.schr ot this district, was formerly attorney for the water com panv and was disqualified. District Judge Jore B, Leslie, or Great Falls, sitting here in place of a local Judge, disqualified on a bias and prejudlco affidavit, denied the application ap-plication of T. C Power, a water company com-pany bond holdor, and other taxpayers for "an Injunction to prevent tho sale of the bonds tomorrow. The supreme court. In a divided opinion today refused to grant a writ sought by the city to compel the dismissal dis-missal of the federal court suit, decided decid-ed later In tho day, and the suit instituted insti-tuted by certain ranchers of Beaver Creek to prevent the bringing in of the Beaver creek water by the city. Tho majority opinion of the court was to the effect that the court was without with-out original Jurisdiction in the matter, which would' be heard on its merits on appeal. The city officials declaro that the victories won today mean the ond of tho long legal fight which has been waged between the city and tho water company for tho past fifteen yenrs. |
