Show CITY IS NOT TO FURNISH A BOND Judge Harris hela a brief session of his court this morning for the purpose pur-pose of passing upon the question whether Ogden city shall furnish an indemnity b6nd in the condemnation proceedings of the city against OrBon Badger and others, recently instituted. Tho attorney for the defendants contended that the city should furnish a bond and tho city attorney contended contend-ed that it should not. The" civil code of the .state law provides that a bond shall bo furnished by the plaintiff in such cases, but there is also a provision provi-sion In the statutes that a municipality municipal-ity Bhall not be required "to furnish an indemnity bond in an7 civil action. ac-tion. The court advised counsel for tho defense that it would be necessary for him to show some legal authority from tho law books why the city I should furnish a bond in the case, before be-fore It would be required. No authority authori-ty for the contention was presented to the court and It was ruled that a bond will not be required of the city |
