ORDINANCE NUMBER 99 AN ORDINANCE OF THE CITY OF SPRINGVILLE, UTAH, LEVYING A SPECIAL SPEC-IAL TAX AND MAKING AN ASSESSMENT UPON PROPERTY PROP-ERTY IN IMPROVEMENT DISTRICT NUMBER 12 FOR THE PURPOSE OF PAYING FOR CURB, GUTTER, AND SIDEWALK INSTALLED THEREIN. WHEREAS, it is necessary to levy and assess upon the property fronting or abutting on the streets so improved and adjacent to such improvements a special tax for the purpose of paying for the same; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SPRINGVILLE, UTAH: SECTION 1. The Tax List for Improvement District Number Num-ber 12, as corrected, approved and completed by the Board of Equalization and Review, which Tax List has been filed with the Springville City Recorder Re-corder and which particularly describes each parcel of land upon which said taxes are to be levied and assessed, setting out the name and address of the owner of each such parcel the number of feet of frontage to be assessed, the rates of assessment, as-sessment, and specifying the amount of tax assessed against the same, is hereby adopted, confirmed and approved, and the assessments made and returned re-turned in said completed Tax List, and the report of the Board of Equalization and Review Re-view to the Springville City Council, are hereby adopted, ratified, approved and confirmed. confirm-ed. SECTION 2. For the purpose of paying the costs and expenses expen-ses of constructing sidewalk, curb and gutter, drive-ways, necessary drainage systems, and doing all other things required re-quired to properly complete the improvements on the streets above designated in Special Improvement District Number 12, there is hereby levied a special tax which is assessed at an equal and uniform uni-form rate, according to the type of improvements installed, upon the porperty fronting or abutting upon said streets and adjacent to such improvements. The total tax hereby levied and assessed upon the parcels of land fronting and abutting on the streets so improved and adjacent to such improvements is in the sum of $31,962.47, which sum is the cost of the abbutor's portion of said improvements im-provements according to the contract entered into for the performance of said work and the making of said improvements improve-ments with Thorn Construction Construc-tion Company, Inc., together with an amount equal to but not exceeding 10 of said cost to cover the actual cost of engineering, a d v ertising, publishing and mailing notices, making the levy, and miscellaneous miscel-laneous services performed in connection therewith, which is added as provided by law. Total tax levied and assessed against abutting property, prop-erty, $31,962.47. SECTION 3. It is hereby adjudged, determined and established es-tablished that each parcel of land assessed will be especially benefited by the improvements constructed and installed adjacent ad-jacent to each such parcel to the full amount of the tax levied, lev-ied, and that the tax is assessed asses-sed at an equal and uniform rate, according to the type of improvement installed, upon the property fronting or abutting abut-ting on the streets improved and adjacent to such improvements. improve-ments. The Springville City Treasurer is hereby authorized and directed to assess and collect col-lect said tax in accordance with the provisions of law and ordinance. SECTION 4. The said special tax shall be due and payable in ten (10) equal annual installments, install-ments, as provided by law and ordinance, with interest on the whole amount of said tax unpaid un-paid at the rate of six percent (6) per annum from the effective ef-fective date of this ordinance, payable at the time each such installment is due; provided, however, that one or more of such installments or the whole tax may be paid without interest inter-est within fifteen (15) days after this ordinance becomes effective, and thereafter one or more of said installments, in the order in which they are payable, or the whole tax up-paid up-paid may be paid at any time by paying the amount thereof plus interest to the next succeeding suc-ceeding installment due date. Said tax shall become delinquent de-linquent if any installment of the principal or interest thereof there-of is not paid on or before the date when the same becomes due and payable. In such event the whole amount of tax unpaid un-paid at the time of such default de-fault shall become immediately due and payable and shail draw interest at the rate of ten percent (10) per annum until paid; and in such event the property against which such tax is levied and assessed may be sold for the delinquent taxes, interest, penalty and costs as provided by law and ordinance. SECTION 5. In the opinion of the City Council of the city of Springville, it is necessary for the immediate preservation preserva-tion of the peace, health and safety of the municipality of Springville that this ordinance become effective prior to the thirtieth day after its final passage.
