Show Full Calandar of Cases Holds District Court Attention Here On Law and Motion Day in Distrct Court on Monday, Judge Edward Shcya heard only two criminal matters. However, the time of the court was also spent in a number of divorce decrees and civil matters. Robert Richard Scott, who has been sentenced by Judge Shcya to a term of from 5 years life imprisonment in the Utah State Prison for the sale of narcotics, has made a motion to be allowed to go to a hospital for treatment rather than to remain at the State Prison. A hearing was to have been held Monday at 2 p.m. to determine whether or not the motion should be granted, but because of the heavy storms between Moab and Salt Lake City, the defence's de-fence's medical witnesses were unable to be present in court on that day. The defense counsel requested re-quested that the court set the matter for next law and motion mo-tion day so that witnesses can be present to testify as to the medical needs of the defen dant. The motion was granted grant-ed reluctantly, Judge Sheyi said, but the court did recognize recog-nize that the weather from Salt Lake City to Moab was hazardous for travel and felt that the defendant should not be denied the opportunity to present medical testimony. During the time between now and the next law an motion day, Scott will remain in the Grand County Jail. The other criminal matter before the court was the State versus E. D. Knapp, who was convicted in January, Janu-ary, 1971 of grand larceny. Sentencing was set for th2 first law and motion day in January but the defendant had left the jurisdiction -of the court. He was finally located lo-cated by the FBI at Littleton, Little-ton, Colo., and was returned to Utah after extradition proceedings pro-ceedings were commenced. The defendant and counsel appeared for sentencing on Monday afternoon and the court asked the defendant the reason that he had failed to appear for sentencing in January. Jan-uary. The defendant stated that he was fearful that he would be sent to prison. Judgo Sheya then sentenced him to serve not less than one nor more than 10 years in the Utah Stat Prison and ordered the defendant to the custody of the warden. Judge Sheya then pointed out to the defendant de-fendant that he had made a serious mistake in leaving jurisdiction and not appearing appear-ing for sentencing because the probation" board had recommended rec-ommended that Knapp be placed on probation and the District Attorney was ready to recommend this to the court. Judge Shela also noted that he had been inclined to grant that probation. Since the defendant fled, however, he is not considered a good risk for probation now and will have to serve the prison term pronounced by the court, Judge Sheya said. Divorces were granted to Floyd Dale Wright from Sharon Lee Wright on grounds ot desertion lor seven ytau, to Alice Marie Byrnes from Robert Michael Byrnes and to Dean Hammer from Juiia Hammer. |
