Show SAYS HE ACTED IN SELF-DEFENSE Womack's Attorney Asks Release of , Prisoner on This Ground. Arguments were submitted in the case of the .State aalnt Frank Womack, charged with murder in the first degree, before Judge C. H. Diclil In the criminal j division of the Cfly court this morning, and the decision was taken under advisement advise-ment by the court until Monday morning at 10 o'clock. Womack was remanded to the county jail until that time. Womack telephoned to the police on the night of October 22 that he had shot and killed Joseph Matthews, at whose house he was a lioardcr. The quarrel which resulted re-sulted In the death of Matthews whs caused by the Jealousy of the latter directed di-rected against Womack. who had been kind to Mrs. Matthews, who conducted a boarding and rooming-house In order to support herself and the other members of the family. Deputy County Attorney Job Lyon, for the. State, argued that Womack had provoked pro-voked the assault committed,, by Matthews Mat-thews by remaining In the house as a boarder after Mat'hcws had toll him fo leave. Attorney Lyon ci ntendcil that Womack had tired three shots into Matthews' Mat-thews' b dv. when but one, was necessary to give him an importunity- to escape, and that when the chance was Riven Womack to escape from his assailant, who was his physical superior, the yortng man failed to grasp the opportunity, but continued to fire at Matthews. Col. M. M. KaK-hn, attorney for the defendant, declared in his ars anient that Mattnews had overpowered Womack, and had assaulted him without sufficient provocation. He declared that Wonmck's actions and attitude in the household had not been iui stionable pi tiny manner, and he also contended that the shooting of Matthews was in M lf-dofense and was wholly justified.
