Show NOVEL FLATIRON SUIT IS THROWN OUT OF COURT Mrs. Henrietta D. Gentry, charged with petit larceny, was before Judge Bowman In police court Tuesday afternoon. Harry J. McRoy. the complaining witness, also was present: In attempting to set tho time for the bearing of the case a legal wrangle ensued between Assistant City Attorney Daltou and the attorney for. Mrs. Gentry. The attorney for Mrs. Gentry contended that the court had no jurisdiction In the case and that hla client. If brought Into court at all. should be sued In a civil ttult. Mrs. Gentry wax charged In tho complaint with the thoft or an electric flatirou. Her attorney maintained that she was merely holding the flatlron for a debt which was due her. Assistant City Attorney Dal tun. however, claimed that Mi's. Gentiy bad entered the premises rented hV Mrs. Cora M Hcndrlekf, the owner of the flatlron. and had la kin the flatirou from tho premises and had refused re-fused to give it up after an order, as well a:; the amount she claimed was due her. had been repeatedly presented to her. Assistant City Attorney Dalton contended that Inasmuch as the occupant bad paid her icnt In advance. Mrs. Gentry, who was a landlady, had no rlghl to wnter the room and take any article belonging to Mrti. Hendricks. In his opinion her ac.i constituted petit larceny. After listening to tho opposing attorneys' .lndgo Bowman said that he would dismiss the case, as he was not certain that tho facts could be proved as represented by both side, lie ?aid thai he thought Mrs. Gentry might be sued civilly. Mrs. Gentry is still holding the flatirou nnd says she will retain possession until the amounts claimed by bcr to be due from Mrs. Hendricks and McKoy arc paid. |
