Thc state board of land commissioners at a meeting held today adopted resolutions requesting tho secretary of" the Interior to promulgate his decision patenting tho Marble Creek lands, valued at approximately $750,000 to tho state, as was suggested by tho supromc court In discussion of thc question ques-tion of modification of the recent opinion, opin-ion, a3 was contemplated by the attorney-general. The action of the board Is taken as precluding all hope of thc settlers set-tlers ever acquiring title under thc adverse ad-verse claims which were of no avail before be-fore the federal authorities. The action was unanimous, all four members of the board, Including Gov. James II. Brady, Sccrotary of State Lansdon, Attorney-General McDougal and Stato Superintendent Su-perintendent Miss Bcllo Chamberlain hc-Ing hc-Ing present. Through tho action taken the board accepts the adverse opinion of tho supromc court on thc demurrer of the attorney-genoral on behalf of the land board to tho application of William Baldorston for a writ of prohibition restraining re-straining tho board from acting on tho report of the Marble Creek legislative homestead commission appointed bv the tenth legislature. Tho decision of tho secretary of Interior, by which It Is understood the lands In question will bo patented to the state, has been withheld for over a year, but In view of thc act of the land board in adopting resolutions resolu-tions it Is anticipated that the decision will In a short time become a matter of record and title of thc .Marble Creek lands pass to the state as against thc claims of settlers, who by tho recommendations recommen-dations of the legislative homestead commission com-mission were to receive a portion of tlinir lands In such instances where It was clearly shown that the entrymen wero bonafide settlers. |
