Show PRISONER WHO FIGHTS EXTRADITION KIDNAPED DENVER, April 28. W A, Muir, the San Francisco broker, charged wiUi cin-bcJKcloiiKMit, cin-bcJKcloiiKMit, who lias successfully resisted extradition for maiiy weeks, was practically prac-tically kidnaped this afternoon by Detective Detec-tive Sergeant .Tolm 33, Freel of the San Francisco police force, and Is on his way to the const. Iduir -appeared before Judge Shattuck of tho west side court this morning on a writ of habeas corpus, -which was denied. de-nied. Judge Shattuck. however, granted a stay of execution until 3 o'clock this afternoon, pending the decision of the supremo court on a writ of supersedeas. Promptly at 3 o'clock, although the supreme su-preme court had not handed down a decision, de-cision, Detective Frccl secured his prisoner pris-oner from the county jail, loaded him in an automobile- and took him Jo Brighton, from which point both boarded' a Union Pacilie train bound for San Francisco. Shortly after 4 o'clock the -supreme court denied the writ of supersedeas, but Muir's allomeys claim that Freel has by his action ac-tion In taking TUuir out of the suto rendered ren-dered himself liable lo, a lino of $1000 or Imprisonment for from one to live years, or both, under the Colorado statutes. Extradition papers have boon honored thrco times by Governor Shafroth and the ease has been bitterly fought In tho courts. Although the chnrgo on which the extradition was asked specilies the sum embezzled as less than 100, the California, Cali-fornia, authorities have expended many limes that sum to secure Mulr's return to San Francisco. Jlulr also haa expended several thousand dollars in 'fighting extradition. |
