Morso's division of tho third, district court Saturday morning, in tho caso of John Lloyd and others against the Citizens' Investment company com-pany and others, the defendants' demurrer de-murrer to tho complaint was overruled and the dofondanta given ten days iu which to answer. The demurrer was to tho effoct that tho complaint did not rccito facts nuf-I'iicont nuf-I'iicont to constitute a causo of action, and asked its -dismissal. The answering of the defendants will join tho issues and tho caso will then go to trial in earnest. Iu view of tho report that the loading spirit of the company building build-ing the stockade, Belle London, has announced an-nounced that tho placo will bo opened December 15. the caso likely will bo rushed toi trial. The plaintiffs aro now in a position lo ask that the defandants bo permanently enjoined from allowing court osans to occupy tho practically completed stockade. |
