Show RECEIVES PAPERS IN CASE OF R. B. SIIEPARD United States District Attorney n. E. Booth is in receipt of tho habeas corpus papers filed with the United States district court in Topeka, Kan., wlych seok to have K. B. Shopard of this city, now confined in the government prison at Fort Leavenworth, transfercd from that prison to the Utah state prison or granted a new trial. The document docu-ment covers nearly twenty typewritten nages and sets forth that Mr. Shooard is being falsoly imprisoned, as Judge John A. Marshall had no right to order tho change in place of imprisonment and that United States Marshal Smyth hnd neither right nor authority to take Mr. Shepnrd to the federal prison at Fort Leavenworth. They further sot forth the fact that there was no evi-denco evi-denco presented at tho trial, which constituted con-stituted a violation of tho United States statute. Mr. Bootb is also iu receipt of a request re-quest that bo attend the hearing to bo held at Topeka on Decomber 17, but is not sure. as yet whether be will or not. He is of tho opinion that the proceedings proceed-ings will not carry, and that Mr. Shopard Shop-ard will remain where ho now is until the cjid of his term. |
