Show DEGREE FOR FERGUSON Sensational Case Decided by Judge Hiles WIFE GIVEN THE CHILDREN Mrs Ferguson Charged Her Husband with Cruelty and He Complained that Sho Had Committed Adultery with a Hired Man Court Concluded Con-cluded tho Evidence of Her Guilt Complete but Allowed Her the I Custody of tho Minor Children Parties Married Ovor Thirty Years I Judge Hiles yesterday handed down his decision In the divorce case of Mary Ferguson vs Isaac Ferguson granting the decree to the defendant on his crosscomplaint but awarding Mrs Ferguson the custody of the four minor children Mrs Ferguson sued for divorce and alimony on the ground of cruelty The defendant denied the charges of cruelty and alleged that the plaintiff had acted cruelly toward him and that she had committed adultery with George Simpson on many occasions occa-sions The parties were married over thirty years ago and have thirteen children all living Judge Hiles in his decision says that the evidence proves that the parties have lived together without any estrangement or complaint against each other until two or three I years ago when quarrels became frequent fre-quent concerning the attentions which were being paid Mrs Ferguson by the alleged adulterous corespondent The court says that up to recently Mrs Ferguson Fer-guson was a reasonably good wife and mother but that the evidence of her having committed adultery frequently Is so strong that an unshakable conviction con-viction of her guilt Is created While the husband Is awarded the divorce the court allows Mrs Ferguson Fergu-son the custody of the four minor children chil-dren on condition that they shall be I properly taught and cared for by her until they become 14 years of age when they may choose a different guardian If they so elect |
