Show SAYS WIFE IIS INSANE Ground of James H Thomass S Suit for Divorce HE CLAIMS HE WAS DECEIVED Alleges that His Wifes Relatives S Fraudulently Kept Him in Ignorance Igno-rance of Her Condition and tliat Ho Was Only Slightly Acquainted With Her When He Jtfarricd Suit to Determine Bight to Drive Cattle on Highway in Parleys Canyon o District Court and Probate Orders I James H Thomas wants a divorce from his wife May A Thomas on the ground that she Is hopelessly Insane and that he was tricked Into marrying i 1 her when sho was of unsound mindS mind-S and that he was nol aware of her con idltlon at that time In the complaintS complaint-S which was filed in the Third District L court yesterday Thomas alleges that he was married to Mrs Thomas In Cleveland county Okla on July 3 1S02 that he had been acquainted with j 4 her only three months and as a matter or fact knew her very slightly He was then but 21 years of age and she oijly 17 lie says that she was then of unsound mind a fact which her father well knew but purposely kept him In Ignorance of that her relatives urged haste In their marriage and fraudulently connived to bring It I about Mrs Thomass mother he says he learned afterward was Insane and If he had been aware of those facts he S would not have contracted the marriage mar-riage Soon after the wedding he says he discovered his wifes mental condition and soon thereafter she became S be-came hopelessly Insane and had to be sent to the Alleghany county home for the Insane at Woodvllle Pa where she now Is He asks for a decree of S divorce and the custody of their fiveS five-S yearold boy Wallace B Thomas D N Straup was appointed guardian of Mrs Thomas for the purposes of the suit suitThomas S S Thomas in the complaint states that he is a railroad operator and agent S 5 Wells vs Davis Affirmed 5 The Supreme court yesterday handed down an opinion affirming the Judgment of the trial court In the case of Heber M Wells appellant vs M W Davis and C II Lashbrook The S action was brought to determine the S rights of the parties to a certain piece of mineral ground In dispute between b the plaintiff and the defendants as the owners of the Wells lode and the Mountain Mayd and Gold Reef mining claims at Bingham The trial court found the issues for the defendants S which Is now afllrmed In an opinion written by District JudgeKolapp and concurred In by Chief Justice Bartch and Justice Miner |
