Show NOTICE OF DEFAULT NOTICE IS HEREBY GIVEN of the default of that certain Trust Deed, together w'ith the indebtedness secured thereby, which Trust Deed is dated September 10, 1979, and was granted to CASCADE DEVELOPMENT, INC., Trustor, and VALLEY BANK & TRUST COMPANY, COM-PANY, as Trustee and Beneficiary, Benefi-ciary, and which was recorded on September 10, 1979, at Page 384, Book 790, as Entry No. 543953, records of the Davis County Recorder, State of Utah, and which Trust Deed embraces real property situated situ-ated in Davis County, State of Utah, which real property is more particularly described as follows: All of Lots 1 through . 17, RIDGE CREST ESTATES, according to the official plat thereof, recorded in the office of the County Recorder of Davis County. (AKA -See Exhibit A) Exhibit "A" Beginning at a point South 53 degrees 43'45" East 282.31 feet and South 26 degrees 10' East 380.34 feet from the West Quarter corner of Section 15, Township 4 North, Range 1 West, Salt Lake Meridian, in the City of East Layton, and running thence North 63 degrees 50' East 115.06 feet; thence North 81 degrees 11'33" East 52.39 feet; thence North 63 degrees 50' East 95.0 feet; thence South 67 degrees 31' East 149.22 feet; thence North 76 degrees 14' East 540.0 feet; thence South 87 degrees 04'03" East 104.40 feet; thence North 22 degrees 29'09" East 69.12 feet; thence South 67 degrees 30'51' East 35.99 feet; thence South 84 degrees 27'42" East 80.15 feet; thence North 60 degrees 48' East 180.51 feet; thence South 67 degrees 30'51" East 43.63 feet; thence North 64 degrees 15' East 127.82 feet; thence South 31 degrees 35'35" East 134.68 feet; thence South 58 degrees 24'20" West 15.17 feet; thence South 69 degrees 19'50" West 123.07 feet; thence South 76 degrees 13'55" West 152.55 feet; thence South 0 degrees 29'55" East 20.95 feet; thence South 75 degrees 59'07" West 1202.03 feet; thence North 26 deerees 10' West 198.81 feet to the point of beginning, excepting that part thereof within the street along the Southerly line of said property. NOW, THEREFORE, pursuant pur-suant to the provisions of Section Sec-tion 57-1-23, Utah Code Annotated, Anno-tated, as amended, the Trustee does hereby give notice that a breach of the obligation for which the trust property was given as security has occurred, and the Trustee does hereby elect to sell or cause to be sold such property to satisfy the obligations secured by the Trust Deed, including appropriate approp-riate fees, charges and expenses ex-penses incurred by the Trustee, Trus-tee, advances, if any, under the terms of theTrust Deed, interest in-terest thereon, and the unpaid principal and accrued interest of the promissory note secured by the Deed of Trust. The nature of such breach by Trustor is the failure of the Trustor to pay the promissory note secured by the Trust Deed. The promissory note was due and payable in full on September 10, 1980, in the principal amount of $190,000.00 together with interest in-terest at the rate of 149?- per annum from September 10. 1980. In addition, there shall be added thereto the costs, fees and expenses of this foreclosure, foreclo-sure, including reasonable attorney's fees and advances by the Trustee.
