THE SYSTEM is used at a number of military activities throughout the U.S. The decision as to whether to set up and utilize a magistrate's magis-trate's court is at the discretion discre-tion of the Chief Judge of each Federal Judicial District. THE U.S. Code provides for a magistrate's court system under the Federal District Court, to try cases involving petty and minor offenses committed on federal property. Judge Daniel Alsop of Salt Lake City is the U.S. Magistrate. Magis-trate. He is expected to hold his courts on base, utilizing the base courtroom. A PETTY offense is a crime for which a maximum penalty of six months imprisonment and a $500 fine may be imposed. im-posed. A minor offense is a crime which may be punished by a maximum of one year imprisonment and a $1,000 fine. COL. DANIEL B. ' MORE SERIOUS offenses, said Colonel Peyser, can be referred to the U.S. Attorney for prosecution in Federal District Court. A petty crime offender will be issued a ticket by Hill AFB security police, for example, for speeding. Within 24 hours the ticket will be sent to the bureau. The offender will have ten days in which to pay the fine or ask for a trial. A TRIAL date could be set by the bureau and conducted by the U.S. Magistrate at Hill AFB. Fines collected under the system will be turned over by the U.S. Magistrate or the Central Violations Bureau to U.S. Treasury. |
