Show oo CHALLENGE OF GRAND JURY TO BE REARD BY JODGE PRATT . District Judge Arthur E. Pratt decided de-cided this afternoon, after hearing argument ar-gument this morning by District Attorney At-torney Stuart P. Dobbs and Attorney J. A. Howell and George Halverson, that he has jurisdiction to decide upon Denny A. Smyth's challenge to the grand jury and he will hear further argument on tho challenge Monday afternoon at 3 o'clock. District Attorney Dobbs contended in his argument that the grand jury was called by District Judge Alfred W. Agee, who had exclusive jurisdiction to hoar any challenge. He based this argument upon tho provision in the compiled laws of Utah, giving each Judge of the district court, where twn are sering. the right to call gran and petit juries for service In his department. de-partment. Judge Agee called this grand jury, said Mr Dobbs, and any i challenge concerning its qualifications should be heard by Judgo Agee. ; Attorneys Howell and Halverson argued ar-gued that Judge Agee himself had transferred the Denny A. Smyth indictments in-dictments to Judge Pratt's department, depart-ment, without their formal request, and that their challenge of the grand jurv Involved the Smyth case only was part of Mr. Smyth's defense. oo |
