Foley of the Falstatf M cafe was acquitted yesterday after- I noon of the charge of selling liquor after 9 o'clock, by a jury composed ot j J. W. Wilcox. John Kern, John Batch-I Batch-I elor and Charles Carson. 1 I The testimony of the defense was to the effect that the alleged beer H that was sold on the night in ques-tion, ques-tion, January 12, was near-beer. The waiter who server the beverage test!- ' fied that he asked William Sumner. fl who was in charge of the cafe at the 11 time, for a bottle of beer for two 41 customers. He was Informed, he said. fi I that no beer could be sold, but that fl he could serve near-beer. William . I Sumner testified that the alleged beer sold was near-beer and Georga C. Foley stated that no beer was ever sold at the Falstaif after 9 o'clock. 11 The witnesses for the city, who y I bought the alleged beer, testified to .WJ luH making the purchase and said that, in their opinion, the liquor served was ?H beer. Detectives H. C. Peterson and 1 Tom Burk told of having employed MM the two men to assist in obtaining H evidence against the cafe and of mak- OH ing the arrest when the alleged beer OH was on the table The witness for ,T ffl the prosecution were referred to as U II stool pigeons by the attorney for the H defense.
