Show Supreme Court Delays Murder Case Action The six-year old Braasch-Sulli-van murder case was again delayed de-layed Saturday when the U. S. Supreme Court issued an order which will have the effect cf staying resentencing of the defendants de-fendants by a state court until un-til after the Supreme Court decides de-cides whether it will hear the case. Defense attorneys for the convicted murderers who openly admitted killing Howard "Duke" Manzione of Beaver in a service station hold-up in 19-19, were notified of the Supreme Court order. The order staying the mandate man-date of the Tenth Circuit Court of Appeajs, which reversed a U. S. District Court decision, was signed by Associate Justice Tom C. Clark. The stay order was issued in response to a petition for a writ of certiorari filed on behalf of defendants Mclvin L. Sullivan, 25 and Verne A. Braasch, 30, by defense counsel, A. Wally San-dack San-dack and Reid W. Niclson. In the absence of a Supreme Court order, the mandate of the Circuit Court of Appeals would have been returned to District Judge Willis W. Ritter by Jan. 2 and the defendants cou.ld have been resentenced any time after that date. On Oct. 27 of this year, the Tenth Circuit Court of Appeals ordered the U. S. District Court to dismiss a habeas corpus writ granted on grounds of deprivation depriva-tion of constitutional rights. The Supreme Court order staying stay-ing the mandate will postpone any further action in the case pending consideration of the petition pe-tition for a writ of certiorari by the Supreme Court. |
