Show Rumors Here oi New Trial lor Condemned Killers oi Howard Manzione Are Squelched No new trial has been granted grant-ed for the condemned slayers of Howard Manzione, according to the two attorneys who were first appointed by the court to handle the case for the defendants. However, a new trial is asked for as a matter of course, but it would be granted only of the Supreme Su-preme Court of the state felt there was a manifest and prejudicial preju-dicial error committed by the trial court. Since the case here in Iron county, new attorneys were appointed ap-pointed by the court to handle the appeal taken to the Supreme Court at the request of the convicted con-victed men. Consequently, attorneys attor-neys Ned Warnock and Wally Sandack of Salt Lake City were appointed by the court to handle han-dle this appeal. The appeal was taken for two reasons only, according to the attorneys one because the convicted con-victed slayers asked for a review of their trial which is a right of every American citizen, and the other because the mother and relatives of the doomed men demanded de-manded it from Gov. J. Bracken Lee. It was pointed out that in Utah no man has ever been executed ex-ecuted without the Supreme Court reviewing the convicition to make sure that no right was Infringed upon. Many persons have expressed dissatisfaction with the delay, including the court-appointed attorneys at-torneys from Cedar City. However, How-ever, since the Supreme Court does not hear cases during the summer, the appeal cannot possibly pos-sibly be heard until the fall term. From what can be learned at the present time, the appeal will appear on the high court docket early in the fall, and be disposed of at the earliest possible time. If the trial court accorded the slayers every right to which they are entitled as American citizens, their conviction will be confirmed confirm-ed and they will We remanded back to the Fifth Judicial District Court for the setting of a new date for execution. |
