Show District Court Session Held Here Tuesday Seventh Judicial District Court was in session on Tuesday in Moab, the Honorable Ho-norable Edward Sheya presiding, and a full calendar cal-endar of criminal and civil ci-vil matters was heard. Betty Sue Isenhart and Sherilyn Warrell appeared appear-ed before Judge Sheya and each entered a plea of guilty to the charge of forgery. The court sentenced sen-tenced Ms. Warrell to serve not less than 1 nor more tha n 15 years in the Utah State Prison. However, upon the recommendation rec-ommendation of the Adult Ad-ult Parole and Probation Dept., this defendant was placed on probation because be-cause she had a good record re-cord free from crime up to this date, and it was shown that her acts were influenced by others, and she was not aware of the commission of an offense. She was further ordered to make full restitution, which she has done. The other defendant, Ms. Isenhart, requested that the court pass judgment judg-ment later since the statute sta-tute provides that the sen- tence not be pronounced short of 48 hours without with-out the consent of the defendant. de-fendant. Date of sentencing sentenc-ing is Feb. 20 at 10 a.m. In the case of Vail F. Hatt vs. Fred Noyes, dba Noyes Plumbing and Heating, and Rex Ivan Rasmussen, defendants, the Court heard the arguments argu-ments of counsel on the defendants' motion for summary judgment. This was a case which arose out of a fire which destroyed a motel being built by the plaintiff at Elgin on March 6, 1973. Mr. Hatt claimed that the motel was destroyed by reason of negligence of the defendants, who deny any fault and claim that the fire could have been started in many different ways. Judge Sheya took the matter under advisement advise-ment and intends to make an early ruling on the motion. In the case of the State of Utah vs. Howard Le-land Le-land Tucker, the defendant defen-dant entered a plea of guilty and the court, at ine requsi oi tne aeten-dant's aeten-dant's counsel, which was concurred in by the State ordered a presentence report and set the date of sentencing for the next Law and Motion day in this county. In the case of the State of Utah vs. Ronald Weiss the defendant was not able to be present because of bad weather in Arizona, and the court set the date of arraignment for Feb. 27 at 10 a.m. In other civil actions. Judge Sheya terminated the guardianship of Madge Hoi linger and reduced the bond in the guardianship of Jamie Lynn Bollinger. The court approved and allowed the first and final fi-nal accounting and granted grant-ed distribution as prayed in the estate of Ferrydoon (Fred) Beijan. Letters of administration were granted in the estate of Ann Marie Woodward. Three divorces were granted: Carole J. Boone from Gene R. Boone; James Walters from Sandra San-dra Kay Walters; and Peter Pe-ter Allen Tcrwilleger from Carolyn Fay Tcrwilleger. Tcr-willeger. Upon the failure of James P. Shannon to appear ap-pear on an order to show cause, the court ordered a bench warrant issued. In the case of F.thleno L. Steele vs. Eugene F. Steele, the defendant appeared ap-peared on an order to show cause. Judge Sheya found that the defendant could have paid a portion of the amount decreed to the plaintiff by the court and therefore found the defendant in contempt. He was sentenced to servo 15 days In the (J rand county jail, but was given the opportunity to purge himself him-self of this contempt by paying $50 a month beginning be-ginning March 5, 1975.
