Show Free-Roaming Horse-Burro Act Remains As a result of a stay of execution granted by a federal judge in New Mexico, the Department of the Interior's Bureau of Land Management will continue enforcement of the Wild Free-Roaming Horse and Burro Act. Paul L. Howard, BLM state director for Utah, explained that a three-judge three-judge district court panel pan-el in New Mexico ruled on February 28 that the Act was unconstitutional. unconstitution-al. The federal government govern-ment was restrained from enforcing the 1971 law. Meanwhile, BLM has requested the Department Depart-ment of Justice to appeal that decision and the judge has granted an order or-der staying the effect of the decision until a decision de-cision is made on the ; appeal. As a result, BLM is continuing to enforce the ; 1971 law and BLM em- ployees have been in- structed to take whatever what-ever action is necessary to prosecute any violat-; violat-; ors. |
