Show FINAL EFFORT TO SAVE CHARLTON Supreme Court Will Hear Arguments Argu-ments in Case the Last oT April. WASHINGTON". March 17. The fight to save Porter Charlton from extradition to Italy for the murder of his wife 'at Lake Como, on their honeymoon, opened today in the supreme court when attorneys attor-neys for Charlton filed their arguments. The court will hear oral arguments probably prob-ably the last of April. Much of the contention con-tention of Charlton's lawyers Is Intended to show that the United States government govern-ment has no power, either by treaty or statute, to turn over to a foreign government govern-ment an American citizen to answer for an alleged crime committed In a foreign country. One of the points relied upon by Charlton's Charl-ton's counsel. It. Floyd Clarke, was the failure of the Italian government to formally for-mally demand the extradition of Charlton within forty days of his arrest, as required re-quired by the treaty or ISfiS. II was argued that since Italy had refused re-fused to allow her citizens to be extradited extra-dited the United States government could not turn one of Its citizens over to Ituly for trial, and that the provision of the Itallun penal code of 1S00. prohibiting the extradition of its citizens, nullified the provision. The point was also made that the New Jersey court erred In not considering Insanity In-sanity as a defense lo the request for the extradition. |
