Show ANSWER DENIES WABASH AVENUE IS PUBLIC STREET Tu the case of Walter G. Tuttlc and others against I felon and Paulo Sowad-zkl, Sowad-zkl, an answer was filed in tho district court Saturday by the defendants, in which they deny that Wabash avenue was over a public highway or that they have wrongfully closed It up and pre-'cntcd pre-'cntcd the plaintiffs from using it. They allege that Salt Lako county wrongfully wrong-fully laid water mains ou tho street and that they intend to remove them because they are being maintained in tho street in violation of an order of the court. They furthermore allege that If tlio street ever was dedicated aa a public highway it ceased to be such on October 30, 1006. and that they havo owned and occupied it ever since July 30, 1001. Tuttlo sued the Sowadzkls to restrain them from closing up tho street and for damages of $3000 for being deprived of" Its use. The street Is in the county and runs east from State street. The county attempted to remove tho house owned by Sowadzkl from tho street and brought an action in court to restrain them from blocking the street, but tho court decided in favor of Sowadzkl and held that Wabash avenue was not a public pub-lic highway. |
