Show THEY ALL GO OUT OIITg Husband Wife and Her Friend in the Pen RESULT OF THE ALLEN TROUBLE AHIe and John Held to the Grand Jury and Aides Husband Detained as a Witness The examination of John Earl the Wonderland Won-derland pianist and Mrs Allie Allen on the charge of adultery was held before Commissioner Greenman yesterday Frank B Stephens prosecuting and Judge Mc Dowall defending Mr Allen the husband of the woman testified that he married her at Salem chapel Denver on February 26 last Something over two weeks ago she left Denver and came to Salt Lake and he followed fol-lowed her arriving here a week ago last Thursday After arriving here he swore out tbe complaint charging his wifoaud Earl with adultery Deputy Marshal Doyle testified that he arrested Earl on the street and on the way to the marshas office the defendant admitted ad-mitted that he was guilty When taken be fore the commissioner Earl again admitted his guilt and asked tho court to make it as easy for them as possible This closed the evidence for the prosecution prosecu-tion and Earl then took the stand Ho testified tes-tified that he knew Mrs Allen in Denver before she was married and was criminally intimate with her for two years prior to her marriage She came on to Salt Lake and stopped at the Yalley house The witness wit-ness also stopped at that hotel but they occupied oc-cupied separate rooms and he never was in her room There had never been anything improper between them since her marriage When he was arrested he supposed it was for what bad happened at Denver before Mrs Allen was married and that was the reason why he stated to the officer that be was guilty Mrs Allen was then called She is aVery a-very handsome and stylish young woman of about 20 She testified that she lived with Earl for two years before she married Allen The latter knew all about her relations re-lations with Earl when he married her She came on to Salt Lake to get an engagement en-gagement as a singer with her husbands full knowledge and consent Mrs Allen stated very emphatically that her relations with Earl had not been improper since her marriage and she corroborated his statement state-ment that he had not been in her room since her arrival here THIS explanation as to why Earl admitted L ad-mitted his guilt was a complete surprise but it didnt disconcert Prosecutor Step hens a bit and by a process of skillful cross examination he succeeded in explod ing the explanation to the satisfaction of the court at least Mr Stephens afollowed this up by a logical argument in which he pointed out the weak spots in the defense Commissioner Greenman said that when Allen appeared to swear out the complaint com-plaint he stated that he had seen Earl enter en-ter Mrs Allens room near the witching hour of midnight When put on the stand he failed to testify to that but still taking into consideration all the testimony and circumstances and the admissions made to the court by Earl he could do nothing but hold the defendants and their bonds were fixed at 1000 each while Allen was held In the sum of 500 to secure his appearance as a witness None of the parties were able to furnish bonds and all were taken out to the penitentiary In this connection it may be said that the Mrs Allen who figures In this case is not Mrs Alf Allen who at one time had charge of the candy stand at Wonderland |
