Show 1 STRUGGLE WITH THE OFFICERS RELATED INCOURT members of the gang arrested deny they arc other than goo d citizens from mondays standard J H boyle thomas shear henry martin and frank matler the four ho boes who in the fight with officer hadlock sunday afternoon were arraigned before judge murphy to answer to the charge of vagrancy and to show why a more serious charge should not be preferred they were all sworn and signified their de sire to make statements tp clear themselves of any part taken in the fight the testimony of officers vance and hadlock was first taken officer hadlock stated that upon request of a number of people who had gone to the river to swim and had been driven away by the hobles hoboes with sticks and rocks he went down to the scene of the trouble to locate the gang of toughs upon entering the brush he changed his for civilian clothes he had not proceeded far when he ran into twelve or fifteen men making a mulligan stew and having a stop and start when you please fight among themselves upon his calling them they scattered but hadlock succeeded in catching the tour prisoners before they could escape boyle who was the most vicious when placed under arrest boasted eliat no officer could arrest him at the same time aiming a blow at the officers head it was then that the officers club came in contact with boyles head BO hard that he waa knocked down officer hadlock also stated that boyle was very abusive while in the patrol wagon and stated that it he had had a gun he would have shot the officer full of holes officer vance was called and corroborated ro the latter part of officer padlocks Had locks statement he also stated that one of the men had tried to bite him in the leg J H boyle was the next on the witness stand he denied all the charges made against him and said that ho did not belong to the gang and had never seen any of them he asked the court to send for manager williams of the candy company and to the federal authorities at pocatello to prove that he wasa was a worker and not a his case was carried over until tuesday thomas testified much after the same order as boyle he stated that he made no resistance when arrested and did not belong to the crowd but was engaged in washing his clothes at the time of the alx up his statement was backed by the officers and it is probable that he will be allowed to go under suspended sentence his case was continued over one day martin and miller made a few rambling remarks each signifying his willingness to work it the judge would allow him to go his honor gave them a chance to teat their ability tor 60 days on the rock pile they were cripples or the full penalty would have been given witnesses will be subpoenaed in the case of boyle and some bad things are expected to be brought out he has been arrested before in pocatello and is no novice in police ways he conducted his defense in a lawyerlike lawyer like manner and questioned the officers with some skill |
