Area 2: City Sewer Lines: Owners of all houses, building or properties used for human occupancy, employment, recreation or other purposes with property lines within 200 feet of a city sewer line must connect to the sewer and pay a con-nection fee. For con-nections to city sewer lines installed by the city since 1970, the fee includes lateral costs, hookup fees, and cost of sewer per linear foot frontage. The con-nection fee is based on a new city ordinance passed by the City Council on March 19, 1985. The connection fee payment may be ex-tended over a longer period of time through the Special Im-provement District. The connection must be made with respect to city sewer lines now existing and a new main sewer line to be constructed on 600 West Street from 1800 North Street to 2600 North Street. Costs on con-structing this new main sewer line will be borne by the city, in part from a federal grant, and owners connecting to this line will be required to pay only the connection fee described above for District is $341,533.93, of which total cost, the Issuer's portion is $139,501.64. The Issuer's portion for the District includes that part of the overhead costs for which an assessment cannot be levied, if any, and the cost of making improvements for the benefit of property against which an assessment may not be levied, if any. The amount to be assessed to the owners of property affected or benefited by the im-provements in the District is $202,032.29, which is the total amount of the assessment hereby levied for the District and which does not exceed in the aggregate the sum of: (a) the total contract price for the improvements under contract duly let to the lowest and best Review to the Council of the Issuer, are hereby ratified, approved and confirmed. Section 4. The assessment is levied and assessed at equal and uniform rates on such property on an area basis. Section 5. The whole or any part of the assessments for the District may be paid without interest within fifteen (15) days after this ordinance becomes effective. Any part of the assessment not paid with such fifteen (15) day period shall be payable over a period not to exceed ten (10) years from the effective date of this Ordinance in ten (10) substantially equal annual in-stallments with interest on the unpaid balance of the assessment at the rate of thirteen percent (13) per annum from unpaid principal shall thereafter draw interest at the rate of 15 per annum until paid. Upon any such default, the Issuer shall give notice, in writing, of the default to the owner ofthe property in default, as shown by the last available equalized assessment rolls. The notice shall provide for a period of thirty (30) days in which the owner shall pay the in-stallments then due and owing, after which the Issuer may accelerate the principal of the assessment, and im-mediately commence foreclosure proceedings under the procedure established by statute for the foreclosure of mortgages. The amounts of accrued interest, and all costs of collection shall be added to the amount of the assessment up to all in the manner and to the extent provided by the laws of the State of Utah. Section 7. The of-ficials of the Issuer are hereby authorized and directed to take all action necessary and appropriate to ef-fectuate the provisions of this ordinance. Section 8. All or-dinances or parts thereof in conflict with this ordinance are hereby repealed. Section 9. An emergency is hereby declared, the preser-vation of peace, health and safety of the issuer and the inhabitants thereof so requiring. Immediately after its adoption, this ordinance shall be signed by the Mayor and City Recorder and shall be recorded in the or-dinance book kept for that purpose. Said improvements are more particularly described in the assessment list for the District which list has responsible bidders therefore; (b) the reasonable cost of utility services, maintenance, labor, materials, or equip-ment, if any; (c) the property price, if any; (d) connection fees, if any, (e) the interest on any interim warrants issued against the District; (f) overhead costs not to exceed fifteen percent (15) of the,sumof fa),z (b Oc) andd),; &iid(gh an, amount for con-tingencies of not to exceed 10 of the sum of (a) and (b). The total assessment for the District is levied at the following rates: Improvement: Area 1 - 1400 East Street; Improvements. Cost: $17.42 per front foot. Area 2 - City Sewer Lines ; Connection fee to line installed prior to 1971, $1,000 per con-nection. Connection fee to line installed since 1970 comprised of the aggregate of the following: 1. $14.00 per front foot to maximum of 150 feet. 2. $400.00 for each lateral from property the effective date of this Ordinance until due; provided, however, that the interest rate on assessments shall be adjusted to the rate or rates of the assessment bonds to be issued as of the date of said bonds. Interest shall be paid in addition to the amount of each such installment annually at the time each in-stallment becomes due. After-sai- d fifteen '(15)" dajPet3'd, alP unpaid installrSints of an assessment levied against any piece of property (but only in their entirety) may be paid prior to the dates on which they become due, but any such prepayment must in-clude an additional amount equal to the interest which would accrue on the assessment to the next succeeding date on which interest is payable on any special improvement bonds issued in anticipation of the collection of the assessments plus such additional amount as, in the opinion of the Treasurer, is necessary to assure the availability of money to the date of foreclosure sale. If the property owner pays the full amount of the installment past due within the thirty (30) day notice period, the assessment of said owner shall be restored, and the default removed, and thereafter the owner shall have the right to make payments in installments as if the default had not oc-- ! purred '- .- ' ' ': Notice 'shall be ef-fective upon deposit of the notice in the U.S. mail, postage prepaid, and addressed to the owner as shown on the last equalized assessment rolls for the County, or on the of-ficial ownership records of the County, Section 6. The Council of the issuer, does hereby reaffirm the creation of a special improvement guaranty fund and shall at the time of each annual appropriation or-dinance, so long as any special improvement district bonds of the Issuer remain out-standing, transfer to said fund each year such amount as a tax ordinance shall be published once in the "Pleasant Grove Review," a newspaper published and having general circulation in the Issuer, and shall take effect immediately upon its passage and approval and publication as required by law. section 10. The City Recorder is hereby authorized and directed to file a copy of the assessment ordinance within five days from the date hereof in the Utah County Recorder's office. If tne assessment ordinance incorporates the assessment list by reference, the City Recorder is further directed to file a copy of the final assessment list with the Utah County Recorder.
