Show i EMILY J. OEM AWARDED DUCES ; er 11 jury i A jury returned a verdict today of $450 damages, with interest and costs ; in the suit of Emily J. Delamater against Ogden City. Suit was brought for damage to the plaintiff's land on Farley avenue, near Twelfth street by a sidewalk built by the city. Mrs. Delamater charged that the sidewalk was 29 inches above the level of her ground and that as a result it had caused water to collect there and had decreased the value of the property. The plaintiff asked for $1000 damages originally. There is a wave in the ground at this particular spot, the evidence showed and the sidewalk had been built to top the hill at the extremity of the plaintiff's property so that it left the bottom of the wave below the surface. Coal men had refused to drive over the sidewalk because of the hard pull, and it had caused a general depreciation of the land. The trial was held before Judge Pratt and Mrs. Delamater Dela-mater was represented by Attorney C. C. Richards. , 00 |
