Y., April 9. -There were persistent rumors today to the i 'fl effect that at least one of the four 1 jH gunmen who are to die at Sing Sing ' Monday morning for the part they .fl played in the murder of HermKli Ro- , .H senthal, the gambler, would confess j ) The rumors could not be traced to their source. Joseph A. Shay, counsel for Charles " Becker, the former police lieutenant, convicted of Instigating the murder, but saved by higher court ruling, said he might go to the prison some time today and endeavor to get statements IH from the four men to be used by the lH defense at the second trial of Becker. In case the condemned men decline to make statements to him, he has prepared an application to the su-preme su-preme court for an order requiring the appointment of a commission to V take their depositions. In either event, it was said, the execution of IH the sentence would not be delayed. H Families Still Hopeful. t Although Governor Glynn has twice refused to grant a reprieve, the fam- jH Hies of the gunmen and their couu- fH sel, Charles G. F. Wahle, had not aH given up all hope today. Ever means known to the law will be em- Pl ployed from now until Monday, Wahle t declared. 1 Today he will send a memorandum to Governor Glynn on the latter's re- t-qH fusal to grant a reprieve. The memo- - randum will take the form of an ar- gument in answer to the governor's r reasons for his refusal. Wahle had i'l at first intended to go to Albany to- day to make a personal plea to Gov. fjri ernor Glynn. The affidavit is signed by aH Frederick Reo, a special officer in a iinl Harlem dance hall. Reo says that uH on tho night Rosenthal was killed, he took a note from a woman, who had 1H been arrested on a charge of dlsor-derly dlsor-derly conduct, to the home of "Dago Frank" and met "Dago Frank'' there. ofr It was then 1:55 q'clock in the morn- tnf ing about the time Rosenthal was murdored. iV,H The memorandum also calls to the najH governor's attention the fact that ten ayH of the twelve jurors who convicted H the gunmen expressed themselves in veH favor of a reprieve.
